1. General
1.1. These Terms & Conditions (the "Terms") govern access to and use of the UnIQum.io website and related services (collectively, the "Service").
1.2. Service operator: MonteCore Solutions (the “Operator,” “we,” “us.”).
1.3. By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, you must stop using the Service.
2. Service Description & No Advice
2.1. The Service provides information and analytical tools such as market monitoring, arbitrage signals, alerts, and other features (the "Functionality").
2.2. The Service is not a broker, dealer, exchange, custodian, payment institution, or investment adviser. Information and signals do not constitute investment, financial, legal, or tax advice. You make your own decisions at your own risk.
2.3. Transactions with crypto-assets involve high volatility and technological and regulatory risks, including the risk of total loss.
3. Right to Use
3.1. The Service is provided "as is" and "as available."
3.2. You represent that you have full legal capacity and meet the minimum age required by the laws of your jurisdiction (typically 18+).
3.3. When creating an account, you must provide accurate, up-to-date information and keep your credentials/tokens secure.
4. Integrations & Third-Party Services
4.1. The Service may integrate with third-party providers (exchanges, wallets, data sources, payment processors, analytics, etc.). Each provider is responsible for its own terms, fees, and availability.
4.2. You enter into relationships with third-party services independently and must comply with their rules. We do not control or guarantee their operation, data accuracy, or execution of transactions.
5. Acceptable Use
You must not:
- (a) violate laws, third-party rights, AML/CFT, sanctions, or export controls;
- (b) circumvent security controls, perform reverse engineering, or conduct penetration testing without our consent;
- (c) distribute malware, spam, content infringing IP rights or privacy;
- (d) use the Service for fraud, money laundering, or any unlawful activity;
- (e) overload the infrastructure (e.g., excessive requests, DDoS).
We may suspend or terminate access for violations of these Terms.
6. Plans & Payments
6.1. Certain features are offered under paid plans/subscriptions; current prices and terms are published on the website. Price changes apply to future billing periods.
6.2. Taxes and fees charged by payment processors and third-party services are borne by the user unless stated otherwise.
6.3. Where portions of the Service are non-returnable (e.g., digital content already delivered, access already granted), refunds may be limited by applicable law and/or our refund policy.
7. Intellectual Property
7.1. Rights to the software, databases, design, and content of the Service belong to the Operator or are used lawfully.
7.2. We grant you a limited, non-transferable, revocable license to use the Service for personal purposes. Copying, modifying, or distributing without permission is prohibited.
7.3. Trademarks and logos are the property of their respective owners.
8. Limitation of Liability
8.1. To the maximum extent permitted by law, the Operator, its affiliates, and partners shall not be liable for any indirect, incidental, punitive, or consequential damages, loss of profits, loss of data, downtime, errors, or inaccuracies of data/signals.
8.2. The Operator's total aggregate liability for all claims is limited to the fees you actually paid for access to the Service in the last 3 months.
8.3. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Warranties & Disclaimers
The Service is provided without any express or implied warranties of fitness for a particular purpose, merchantability, non-infringement, or otherwise. We do not warrant uninterrupted operation, error-free performance, or the timeliness/completeness/accuracy of data or signals.
10. Legal Compliance
10.1. You may use the Service only where lawful.
10.2. We may apply KYC/AML measures as needed and comply with lawful requests of public authorities.
11. Termination
11.1. You may stop using the Service at any time. We may restrict or terminate access upon violations of these Terms or in other cases provided by law.
11.2. Sections 6–9 and 12–14 survive termination.
12. Changes to the Terms
We may update these Terms; material changes take effect upon publication on the website. Continued use of the Service constitutes acceptance of the updated Terms.
13. Privacy
Processing of personal data is governed by our Privacy Policy available on the website.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of Montenegro, without regard to conflict-of-laws rules. Disputes shall be resolved by the courts of Montenegro, unless mandatory law provides otherwise.
